General terms and conditions of sale (GTCS)

General

MUZOO is an institution of the City of La Chaux-de-Fonds, attached to the Dicastère de l’instruction publique, de la culture et de l’intégration (DICI).
The present general terms and conditions of sale (hereinafter CGv) – which MUZOO reserves the right to modify at any time – apply, without restriction or reservation, to the purchase of tickets for visits to the museum or access to events (hereinafter event) organized by MUZOO, to the conditions of access to and use of the services offered and to the purchase of items from the boutique.

The GCS apply to the exclusion of all others. They are accessible at all times on the muzoo.ch website (hereinafter referred to as the website), and shall prevail, where applicable, over any other version or any other contradictory document.

Anyone purchasing a ticket or item from MUZOO confirms that they have read and accepted the Terms and Conditions, which form part of each ticket or item sold.

Under the terms of the GCvs, the term “ticket” applies to all forms of access (including tickets, packages, subscriptions, invitations and entertainment purchases).

1 Box office

1.1 Purchasing a ticket :

MUZOO strives to offer buyers a professional, quality service with all due diligence. However, MUZOO cannot guarantee an uninterrupted and faultless supply of services, nor can it exclude intrusions into computer systems or misuse by third parties. MUZOO therefore declines all responsibility for damages that may result from such circumstances. Liability for services provided by third parties in connection with ticket sales is excluded.

Purchasers and users of the website are assumed to be familiar with electronic means of communication and to be aware of the data security risks associated with their use. Users undertake to make only legally acceptable use of these electronic means. The Internet site is understood to be the official site supplemented by any other computer platform used by MUZOO for its ticketing and online store. The GCvs also cover the activities of IT service providers MUZOO may call upon.

MUZOO declines all responsibility, within the limits of legal provisions, for any damage that may occur to the computer system of the ticket purchaser or any third party, which may be related to the use of the website or services.

1.2 Tickets :

The contract for the purchase of a ticket is based on the GTC and the general terms and conditions of the ticketing partner, whichever apply first. By purchasing a ticket, the purchaser accepts the provisions concerning security, access and additional regulations relating to the event in question. Furthermore, the buyer is aware that in the event of failure to comply with these regulations, he/she will be refused access to the event without compensation.

Tickets can be purchased on the website, on site at the MUZOO box office, from MUZOO’s ticketing partners (official sales outlets), as well as, if applicable, from other web platforms to which MUZOO has expressly granted a license. Any ticket purchased by any other means may be refused by MUZOO.

Ticket prices are quoted in Swiss francs, including VAT (where applicable and at the current rate).

The various prices and free entry fees are explained on the ticketing information material, particularly on the website.

Tickets are only issued to the purchaser once payment has been authenticated and validated. This authentication and validation is the sole responsibility of the credit organization used by the purchaser, or respectively, of the body to which the organization has mandated these controls.

1.4 Ticket control, fraud protection :

MUZOO verifies the validity of the ticket at the entrance to the event by electronic means. We reserve the right to check the legitimacy of the ticket holder.

Access to the event is not guaranteed after the scheduled start time. Refusal of access due to the ticket holder’s lateness does not entitle the holder to any refund.

A ticket is reserved for the use of a single person, for a single passage. The purchaser of the ticket will be held responsible in the event of multiple use of the ticket. As such, he/she is responsible for keeping his/her ticket(s) in a safe place, in order to avoid any theft, falsification or indelicate copy.

The purchaser undertakes to protect the ticket against damage caused by wear, light, moisture or dirt. If barcodes or QR codes are damaged in any way, tickets cannot be verified and access cannot be authorized.

The user of a reduced-price ticket (e.g. student, AVS or AI fare) must be able to legitimize his or her status at all times. If this is not the case, they will be asked to pay an additional adult ticket fee.

The ticket must be kept until the end of the event and presented on request.

The ticket holder attends the event to which the ticket gives access at his or her own risk. All exits are considered definitive, except in exceptional cases when a counter-mark valid only with the present ticket will be issued.

Resale of tickets is prohibited. Only tickets purchased at an official sales outlet are valid.

1.5 Cancellation, postponement and refund :

Refunds, exchanges and returns of tickets are not possible.

1.5.1 Program change :

MUZOO’s program is systematically communicated via its various means of communication, even in the event of modifications. Program changes, even at the last minute, are always possible. Under no circumstances will these changes entitle the holder to a refund or exchange of ticket.

If an event is postponed, the ticket is valid for the postponed date only. These modifications do not entitle the customer to a refund.

In the event of cancellation of an event, reimbursement of tickets is a priori excluded. MUZOO nevertheless reserves the right to decide whether or not to refund or exchange tickets, depending on the context of the cancellation.

1.5.2 Force Majeure :

In the event that MUZOO is forced to cancel or postpone the event due to Force Majeure or a cause beyond its control, there is no right to ticket reimbursement.

Force Majeure is defined as any external and/or unforeseeable event, beyond MUZOO’s control or actions, that makes it impossible or particularly dangerous to hold the event, for example: terrorist threat, public calamity, war, epidemic, pandemic, fire, flood, strikes or national restrictions, earthquake, extreme weather conditions.

It is specified that in the event that circumstances of Force Majeure have made the holding of the event financially or technically disproportionate, MUZOO reserves the right to cancel or postpone it, even if the said event of Force Majeure had disappeared before its start but made its preparation impossible or prevented the constructions necessary for its smooth running.

It should be noted that MUZOO’s obligations will be suspended in the event of an event constituting a Force Majeure and the suspension of obligations will in no case be a cause of liability for non-performance of the obligation in question, nor lead to the payment of damages or late penalties.

2. Access to the event, behaviour and safety

2.1 Access :

Entry to the event is subject to presentation of a valid admission ticket in accordance with section 1 above.

All visitors are required to undergo a security check at the entrance to the event, at the request of the staff, in particular to check for the presence of prohibited items.

The following rules apply to access to the site:

Except for events specifically organized for children, all visitors and participants under the age of 12 must be accompanied by an adult.

It is forbidden to bring the following objects into the event enclosure, without this list being exhaustive, the decisions of the event staff being taken as authentic where applicable:

  • Pyrotechnic objects of all kinds, explosive, flammable or volatile substances and, more generally, any object likely to be used as a projectile,
  • Weapons or objects assimilated to weapons, all sharp or blunt objects,
  • Animals,
  • Drones,
  • Professional photographic and recording equipment (excluding pocket or digital cameras or cell phones).

It is forbidden to sell or distribute products of any kind within the event and its surroundings, and to organize gatherings without the organizer’s authorization.

2.2 Sound and image recording :

It is permitted to capture and/or record sounds and/or images during the event for private use only. No commercial use may be made of these recordings.

MUZOO reserves the right to prohibit any recording.

Areas located within the MUZOO enclosure or where events take place may be filmed or photographed by the organization or authorized media. Any person entering the site expressly consents to the use of his or her image and voice, free of charge and without compensation, for any and all uses that may be made thereof in current and future media.

2.3 Behaviour and offences :

Follow the instructions of the organizers and their staff (including security personnel, police and fire department).
The ticket holder accepts the instructions of the CGv and the measures (including health measures) that may be imposed by law.

The ticket holder acknowledges that he/she may be escorted from the event premises, without compensation, if he/she fails to comply with the GCvs. Depending on the circumstances and at MUZOO’s sole discretion, a permanent or temporary ban on entry may be ordered, without compensation. All claims for damages are reserved.

MUZOO reserves the right to notify the Authority.

MUZOO may confiscate material introduced or used in a manner contrary to the GCS. The equipment will also be handed over to the police.

3. Information

MUZOO can offer no guarantee as to the completeness, timeliness and accuracy of the information disseminated on its means of communication, nor can it exclude transmission errors. MUZOO cannot be held responsible for any damages or actions that may result. However, MUZOO will make every effort to ensure that the data and information published on its website are always complete, up-to-date and accurate.

MUZOO cannot guarantee the content published on third-party websites or means of communication.

4. Intellectual Property

The entire content of the website, exhibitions, publications and events is the property of MUZOO. This content is protected by applicable intellectual property rights (copyright, etc.).

Any total or partial reproduction of this content is strictly prohibited and may constitute an infringement of copyright.

MUZOO remains the owner of all intellectual property rights on photographs, presentations, studies, drawings, models, prototypes, etc., produced for the purpose of providing the services offered. Their reproduction or use is prohibited without the express, written and prior authorization of MUZOO, which may also require financial compensation.

Any download or copy of a page or part of the website may only be made for strictly personal use.

5. Data protection

Personal data communicated by purchasers is used solely to enable the use of services offered by MUZOO.

MUZOO undertakes not to transfer data concerning buyers to a third party, except for the necessary communication of data to ticketing, boutique or cafeteria partners, for the proper functioning of the services provided by the latter.

All personal data will be kept confidential. Only the data required to carry out the commercial process will be kept.

The Data Protection Act and the General Data Protection Regulation also apply.

6. Characteristics of communication networks

Purchasers and users of the MUZOO website and/or other electronic media are assumed to be familiar with electronic means of communication and to be aware of the data security risks associated with their use.

They consider themselves fully informed of the risks inherent in the use of telecommunications networks. It is reminded that the transmission of data by communication networks only benefits from relative technical reliability, and MUZOO cannot be held responsible in the event of :

    • data hijacking,
    • intrusion of unauthorized third parties on the services offered,
    • computer-related offenses,
    • network saturation.

The services offered by MUZOO on its website or through its other media may be subject to scheduled or unscheduled interruptions. The MUZOO cannot be held responsible for any unscheduled interruption for which it is not at fault.

Users undertake to make only legally acceptable use of these electronic means. The MUZOO website is understood to be the official website supplemented by any other computer platform used by MUZOO to carry out its online ticketing.

7. Limitation of liability

MUZOO excludes all liability for personal or material damages arising from the organization or running of the event.

In particular, the following limitations of liability apply:

The program communicated by MUZOO is subject to change.

MUZOO makes every effort to provide the best possible information to users of its website. However, it cannot absolutely guarantee the accuracy, completeness and veracity of the information presented.

MUZOO is not liable for damages resulting from telecommunication errors, technical problems, system failure or illegal manipulation of the computer systems involved, regardless of the location and form of the alteration. Furthermore, any liability for damage caused by malfunctions, interruptions or overloading of the computer system is excluded.

MUZOO is not liable for any direct or indirect damages arising from the services or information offered on its website, except in the case of gross negligence or wilful misconduct for which it is responsible.

Liability for damage caused by links to other websites is also excluded. MUZOO insists on the fact that a disturbance can result from other Internet sites unknown to MUZOO and will decline any responsibility concerning the contents, the products, the services and other services provided by these sites.

The information provided on the MUZOO website is for private use only and is intended to inform a person who may participate in the proposed events. Users are advised that information may be changed at any time without notice.

MUZOO provides its services within the framework of its resources and foreseeable requirements in a diligent manner.

8. Modifications, escape clause

MUZOO reserves the right to adapt and modify its GCS at any time.

Modifications to the GCS are communicated in an appropriate manner, in particular by a corresponding publication on the MUZOO website. Regular consultation is therefore recommended.

The invalidity or inapplicability of certain clauses of the GCS shall not affect the validity of the other clauses of the GCS.

9. Applicable law and legal notice

This contract is governed exclusively by Swiss law. Jurisdiction is determined by MUZOO’s domicile.
